Protecting Your Home from Deed Fraud: The ALTA 49 Forgery Endorsements

Real estate fraud is unfortunately on the rise, and one of the fastest-growing threats to property owners today is seller impersonation fraud. Criminals are increasingly using sophisticated tactics, stolen identities, and forged documents to impersonate property owners, sell or mortgage homes that don't belong to them, and vanish with the proceeds.

To combat this growing threat and provide homeowners with enhanced peace of mind, the American Land Title Association (ALTA) has released two new title insurance endorsements: ALTA 49 and ALTA 49.1.

Bridging the Coverage Gap

Standard ALTA Owner's Title Insurance Policies are essential tools for protecting your property rights against title defects—including forgery—that occurred prior to the date you purchased the policy. However, standard policies traditionally do not cover fraudulent acts that happen after your closing.

That’s exactly where these new endorsements come in. They provide critical post-policy coverage against financial loss caused by a forged deed or mortgage recorded in the public records after your closing date, without your knowledge or consent.

What are the ALTA 49 Endorsements?

Depending on whether you are buying a new home or looking to protect the one you already own, there are two variations of this coverage:

  • ALTA 49 (Forgery – New Owner's Policy – Residential): This endorsement is designed for homebuyers currently purchasing a property. It allows you to add post-closing forgery protection to a standard ALTA Owner’s Policy right at the closing table.
  • ALTA 49.1 (Forgery – Existing Residential Owner's Title Policy): This endorsement is designed for current homeowners who already hold an existing standard ALTA Owner’s Policy. It allows you to proactively add future forgery protection to your existing coverage without needing to purchase an entirely new title policy.

Who is Eligible?

These endorsements are specifically tailored for everyday homeowners rather than commercial investors. To qualify for the coverage:

  • The property must be an improved one-to-four family residential home.
  • The insured owner must be a "Natural Person" (a human being) or an "Estate Planning Entity" (such as a living trust established for estate planning purposes).
